About the seminar

This talk will try to clarify those aspects of both the civil and common law
traditions that perplex not only non-lawyers, but also lawyers schooled in
one but not the other tradition. It will explore the influence that
legislation, court decisions, judges, and lawyers exert in both traditions.
Most particularly, it will strive to explain what “thinking like a lawyer
means’” in the common law tradition, a form of analysis propelled by
facts that seems to civilians, at least on first contact, crude, arbitrary,
unsophisticated, and unprincipled.

About the speaker

Professor Finbarr (Barry) McCarthy is Associate Professor of Law at Temple
University in Philadelphia, currently seconded to the university’s Japan
Campus. He earned a B.A. Moderatorship from Trinity College, Dublin, a
postgraduate diploma in the economics of European Integration from the
University of Amsterdam, and both a Ph.D. in English and American Literature
and a J.D. from Tulane University. Besides having worked for the Revenue
Commissioners in Ireland as a tax inspector, he was a Bigelow Fellow at the
University of Chicago Law School and clerked on the United States Court of
Appeals for the Fifth Circuit. Professor McCarthy teaches property law,
trusts & estates law, comparative employment law, corporations, and the
Global Workplace.
